Can My HOA Fine Me for a Brown Lawn in Spokane?

The Short Answer

No — not during a declared drought period. Under Washington state law (RCW 64.38.055), HOAs cannot fine homeowners for reducing or eliminating irrigation of lawns or landscaping during any period when a state or local drought emergency has been declared. Washington is currently under a statewide drought emergency, declared April 8, 2026.

What the Law Actually Protects

  • You cannot be fined for a brown, dormant lawn caused by following city watering restrictions during a declared drought
  • HOAs cannot require water-intensive turf as the only allowed landscaping
  • HOAs cannot block drought-tolerant landscaping, xeriscaping, or wildfire-resistant landscaping outright — though they can set reasonable rules about placement and appearance

Fine Procedure Requirements

Under RCW 64.38.020(11), your HOA must have an adopted fine schedule provided to owners before any violation, and must give written notice before a disciplinary hearing. A fine issued without that process may not be valid.

Spokane’s Current Watering Rules

The City of Spokane runs Level 1 restrictions (June 1–October 1): no watering 10am–6pm, limited to 4 days/week. Level 2 (stricter) activates if the Spokane River drops below 1,000 CFS at the Lower Crossing gauge and a drought emergency is declared. As of 2026, enforcement of these city rules is on an honor system.
